When was OHOA established?
Oakshire Homeowners Association was incorporated March 16, 1990 in the State of Missouri.
Is membership in the association mandatory?
Yes, if you are a property owner within the legal boundaries of the Association, you automatically became a member of the Association when title was transferred to you. A home owner cannot "opt-out" of membership.
Are there architectural controls and other restrictions within the Association?
Yes, there are strict legal controls within the community, which homeowners are required to follow. It is always safest to check with the Architectural Review Committee for a permit prior to any changes or additions to your property. Controls and restrictions are outlined in the CCR's and may be viewed on this site.
How do I get a copy of this Association's governing documents?
Every homeowner should have a copy of the Association Bylaws and the Declarations of Covenants, Conditions, and Restrictions (CCR's). These Declarations are public record and are on file (Instr #425961, Book 3788, Page 91) with Johnson County's Recorder of Deeds.
Does the Association have a Board of Directors?
Yes, a Board of Directors is comprised of volunteer homeowners from within the Associational boundaries, and elected as outlined in the Bylaws. We believe strongly community associations are the grass roots level of democracy. Owners in our association freely elect neighbors who volunteer to serve on the Board of Directors for Oakshire Homeowners Association. Neighbors serve on committees and help with special tasks as needed. A board meeting at a community association is comparable to a town council meeting of a municipality.
Who may become a director?
The full qualifications are outlined in the CCR's and Bylaws. Basically, any property owner, in good standing, may be elected to the Board.
How can I become a director?
Nominees to the Board of Directors are selected by the Nominating Committee, usually 30 days prior to the annual meeting (which is usually held in the month of October). If you wish to serve on the Board, please contact a Board member to have your name considered by the Nominating Committee.
What are the dues of this Association and what are they used for?
Dues are assessed from July-June of the following year and vary from property to property. Bills are typically mailed to the property owners in May or June of each year and are due July 1st. For the current due, or to set up a payment plan, contact the Treasurer of the Board. Dues are used to maintain all Common Properties of the Association (ex. repairing our chip and seal roads, maintaining road right of ways, fire hydrants, etc.) as well as any administrative costs associated with running our HOA.
If I am selling a home within the Association's boundaries, am I responsible to pay the entire annual assessments due?
Yes, you must pay all property dues in full by July 1st. At closing, you will receive back the partial amount for the months you do not own the property. You or your Real Estate agent may contact the Board President or Treasurer with any questions.
What will happen if I do not pay my assessments on time?
A $5 monthly late fee is assessed when the dues are not paid by July 1st. To avoid paying late fees, contact our accounting firm or the Board Treasurer to set up a monthly payment plan. If a property has gone two years without paying assessments, our HOA attorney will take legal action to recover the late dues as well as all court costs associated with the litigation proceedings. All cost associated with the collection process will be assessed to the homeowner.
If I am purchasing a home within the Association's boundaries, how can I find out the status of assessments?
You or your Real Estate agent may contact the Board President or Treasurer.
If there are unpaid assessments on the home I purchased, am I liable for them?
Yes, the obligation is on the property, not the individual or individuals. If you accept the deed for a property, all unpaid assessments are transferred along with title.
